In what appeared to a joyous moment for actress Kelly Rutherford and her two children, Hermes and Helena, the family got to sit down together on July 4 outside an Italian restaurant on Saturday, according to Us Magazine.

The bitter custody battle has taken an international dramatic turn as her ex-husband, German businessman Daniel Giersch, had been deported from the U.S. and unable to enter the country through legal means. He had taken up residence in France and Monaco, where the kids had been ordered to live with their father following his deportation and legal issues.

This has been at the cost of Rutherford, who had previously filed for bankruptcy due to the mounting legal fees and over $2 million in debts.

According to Entertainment Weekly, the judge in Monaco had ruled on June 22 that the children were to go the U.S. and spend the summer with their mother. But they were to be returned after the end of the summer to live with their father.

This is where international law involving familial affairs comes into bitter turmoil.

In May, a California judge granted sole custody to Rutherford over her two children, who had been living with their father abroad since 2012. But Giersch also had habitual residents status in Monaco, which meant that the children could not be removed from the country, according to TMZ.

But now, following the arrival off her children in the U.S. after the judge in Monaco ordered their visit with their mother, it is unclear if Rutherford would still be within her rights to keep the children here in the U.S. given her victory for sole custody in California.

That is indeed her right in the U.S., but it is contradictory to what the judge in Monaco ordered, which was for the children to be returned at the end of the summer.

This international custody battle with the actress and her wealthy ex-husband will still continue to play out, and it is hard to see where it will end up at the end of the summer.
