"NCIS" star Michael Weatherly is facing DUI charges after being collared by police in Los Angeles.

TMZ reports earlier this month the cops stopped Weatherly for speeding in Hollywood and immediately detected he seemed under the influence. After a series of tests, Weatherly's BAC was determined to be well over the legal limit, resulting in him spending about 15 hours in custody.

The L.A. City attorney has since formally charged him with two counts of DUI and if convicted he could face up to six months behind bars and fines of as much as $1,000.

Earlier this year it was reported Weatherly, who stars as agent Tony DiNozzo, was contemplating leaving the show after launching his own production company. Weatherly has been a part of the "NCIS" cast for each of its 13 seasons.

Fox News reports his first production for his new company will be the "gritty" adaption of the novel "Little Women" for The CW.

Weatherly recently stressed he remains grateful for his "NCIS" opportunity and can still remember the days when he was left to sing for his supper in the subways of New York City.

"Singing on the subway was part of a survival technique employed by me in the early 1990s," he said. "I didn't have a lot of overhead, so I didn't cost too much to take care of. I ended up learning how to state your case in 30 seconds. I would basically play the chorus of a song and then a subway would come, and then I'd play the chorus of another song."

Now in its 13th season, "NCIS" airs on Tuesdays on CBS. The show also stars Mark Harmon as agent Jethro Gibbs, Pauley Perrette as Abby Sciuto, Sean Murray as Timothy McGee and Rocky Carroll as Leon Vance.
