The Colorado State Supreme Court has ruled that Donald Trump is ineligible to run as president in the state under the 14th Amendment as he led a rebellion on January 6, 2021. This means that he is now disqualified from the Colorado ballot for 2024.

This historic decision has sent shockwaves all over the country as the state's highest court concluded that Donald Trump did engage in an insurrection during the January 6 Capitol Insurrection. The decision might affect other efforts to disqualify Trump from the ballot in other states.

"We conclude that ... President Trump engaged in insurrection," the Colorado Supreme Court justices wrote in their 4-3 ruling. "President Trump's direct and express efforts, over several months, exhorting his supporters to march to the Capitol to prevent what he falsely characterized as an alleged fraud on the people of this country were indisputably overt and voluntary."

"Moreover, the evidence amply showed that President Trump undertook all these actions to aid and further a common unlawful purpose that he himself conceived and set in motion: prevent Congress from certifying the 2020 presidential election and stop the peaceful transfer of power," the justices added in their decision.

"We do not reach these conclusions lightly," added the majority of the court. "We are mindful of the magnitude and weight of the questions now before us. We are likewise mindful of our solemn duty to apply the law, without fear or favor, and without being swayed by public reaction to the decisions that the law mandates we reach."

"We conclude that because President Trump is disqualified from holding the office of President under Section Three, it would be a wrongful act under the Election Code for the Secretary to list President Trump as a candidate on the presidential primary ballot."

Colorado Supreme Court Decision on Donald Trump Disqualification Sets Up US Supreme Court Battle

The Colorado state Supreme Court decision can still be appealed, and Trump's attorneys vowed to take the Donald Trump disqualification case all the way to the US Supreme Court, according to the Associated Press.

"The Colorado Supreme Court issued a completely flawed decision tonight and we will swiftly file an appeal to the United States Supreme Court and a concurrent request for a stay of this deeply undemocratic decision," said Trump campaign spokesman Steven Cheung in a statement shortly after the Colorado ruling.

Why Did the Colorado Supreme Court Disqualify Donald Trump?

The merits of the decision lie completely in the 14th Amendment of the constitution, which disqualifies officials from seeking future office if they "engaged in insurrection," which the court found Donald Trump did.

This Colorado Supreme Court decision reverses a previous Colorado lower court decision that decided that while it did find Trump engaged in an insurrection, a provision in the Constitution was unclear whether it was intended to bar candidates for the presidency, according to the Daily Mail.
