In a major setback for keeping the March 2024 trial for Donald Trump's federal election interference case, the Supreme Court denied Special Counsel Jack Smith's request to hear the question of Trump's immunity. This is considered a rare victory for Trump's legal team as they continue their "delay delay delay" strategy to delay all of the former president's cases after the election.

Smith tried to fast-track the case to prevent that usual Trump delay tactic by skipping the appeals courts and therefore prevent the case from being bogged down by appeals. However, the move was a rare step and the Supreme Court rejected his request and did not explain its reasoning and there were no notable dissents in the decision.

What happens next may be happening on January 9 when an expedited review of the Trump immunity question is already underway at the DC Circuit. Oral arguments are scheduled for that day. However, with Trump's delay tactics, the election subversion trial scheduled for March may not begin as scheduled.

"I was President, it was my right and duty to investigate, and speak on, the rigged and stolen 2020 Presidential Election. Looking forward to the very important arguments on Presidential Immunity in front of the DC Circuit Court of Appeals!" he wrote on Truth Social shortly after the Supreme Court's decision not to hear the case about his immunity, according to CNN.

Judge Tanya Chutkan previously rejected the former president's immunity claims, finding that his efforts to overturn the election were done as a candidate and not part of his duties as president.

The DC Circuit Court of Appeal quickly decided to schedule oral arguments on the immunity claim and legal analyst Andrew Weissmann says that because of this, the Supreme Court's denial is "not that surprising."

Weissman added that how the justices respond after a ruling from the court of appeals will be important to watch as it might be "tricky" for Jack Smith and his prosecutors to secure a trial date before the 2024 presidential election if the justices don't expedite their review of the immunity claim.

The question of Trump's immunity is at the heart of the former president's legal arguments, as he feels he is entitled to do whatever he wants without repercussions. However, Judge Chutkan rejected this argument and it is now heading to the DC Circuit.

As the BBC noted, should Trump delay it after the US presidential elections in 2024 and Trump wins the election, he may have his new DOJ, which he vowed to fill with loyalists, drop the cases against him entirely.

Legal analysts and experts fear that Trump may never face justice should he win the presidency as he may just pardon himself and use his immunity from prosecution and become a dictator.
