Texas Governor Greg Abbott on Thursday blamed President Joe Biden for the influx of illegal immigrants on the U.S.-Mexico border and announced a new executive order that would send back the said migrants to the border.

Abbott called his order "unprecedented," claiming that Biden "refused to do his job" regarding immigration, according to New York Post.

"While President Biden refuses to do his job and enforce the immigration laws enacted by Congress, the State of Texas is once again stepping up and taking unprecedented action to protect Americans and secure our southern border," the Texas governor underscored.

In his executive order, Abbott pointed out that Biden's "failure" to safeguard the border has prompted action from the Lone Star State to ensure its safety, defend its sovereignty against violence, and territorial integrity.

Abbott also said in the order that Biden's open-border policies were referred to by the cartels as an invitation, which reflects the perception that the U.S. president welcomes immigrants, prompting them to engage in dangerous treks across the southern border.

The executive order GA-41 announced by the Texas governor on Thursday allows the Lone Star State's law enforcement to return illegal immigrants apprehended in the state back to the U.S. border, Fox News reported.

Abbott has specifically ordered the Texas National Guard and The Texas Department of Public Safety to do the task. The governor emphasized that the move aims to stop criminal enterprises from endangering the state's communities.

It is known that only the federal government is allowed to enforce immigration laws.

However, Abbott called the issue an "invasion," leading him to justify his executive order through Article IV § 4 of the U.S. Constitution, which states that the U.S. should protect each state against "invasion." The Texas governor then noted that the said issue forces the state to build a border wall and deploy military forces to secure it from illegal immigration that gives funds to the cartels.

Previously, Former Donald Trump official Ken Cuccinelli said that he wanted Abbott to declare an "invasion" and enact a Title 42-style policy.

However, Cuccinelli on Thursday said in a statement that the Texas governor's move does not direct the law enforcement in the state to remove illegals across the border directly to Mexico.

"That is critical. Otherwise, this is still catch and release," he said.

Meanwhile, legal analyst Jonathan Turley previously told Fox News that Abbott's new executive order is a misinterpretation of the Constitution. Turley explained that "invasion" in the Constitution is interpreted as an attack from a foreign army or an organized force.
