New Mexico's First Judicial District Attorney's office announced Tuesday the resignation of the special prosecutor assigned to the Alec Baldwin "Rust" shooting case.

After "much reflection," special prosecutor Andrea Reeb said she made "the difficult decision" to resign, CNN reported.

Reeb emphasized that getting justice for the victim was her first focus, as it had been in every case she had prosecuted in her 25-year career.

But she noted that it has become evident that the best way she can secure justice, in this case, is to leave so that the prosecution may focus on the evidence and the facts, which reveal a complete disregard for basic safety protocols that led to the death of Halyna Hutchins.

"I will not allow questions about my serving as a legislator and prosecutor to cloud the real issue at hand," she added.

Alec Baldwin's Counsel Asked to Remove Special Prosecutor Andrea Reeb in 'Rust' Shooting Case

Due to her position as a member of the New Mexico House of Representatives, Alec Baldwin's counsel argued in February that Andrea Reeb should be removed from her role as special prosecutor because her involvement in the case is "unconstitutional" under New Mexico law.

Baldwin's attorney said in a motion filed with the First Judicial District Court of New Mexico that Reeb, a member of the New Mexico House of Representatives, should not be allowed to sit at the prosecutor's table because a "sitting member of the Legislature may not 'exercise any powers properly belonging' to either the executive or judicial branch."

A court hearing was reportedly set for March 27 to tackle the motion. But although the paperwork was filed in the court, CNN reported that it does not show up on the court docket as of Tuesday afternoon.

Alec Baldwin 'Rust' Shooting Incident

Halyna Hutchins died on October 21, 2021, after Alec Baldwin discharged a prop gun on the set of the Western feature film, "Rust," in New Mexico.

Police said deputies were dispatched to the film set at Bonanza Creek Ranch in Santa Fe after receiving an emergency call about the accidental shooting on the set.

Halyna was transported via helicopter to the University of New Mexico Hospital, where she died from her injuries. Aside from Halyna, "Rust" director Joel Souza was also injured and hospitalized but survived. Investigators are still investigating the incident.

No one has been arrested or charged as the investigation continues on how the tragic shooting occurred. The case brought by Hutchins' husband and child has been resolved, but her parents and sister have decided to pursue legal action.

There was a pause in filming the "Rust" movie after the shooting incident, but it will reportedly resume this spring.

Rust Movie Productions said Hutchins' husband would serve as the movie's new executive producer while Blanca Cline is the new cinematographer.

Souza will return as director, but it is still unclear where the filming will take place. Rust Movie Productions has prohibited the use of "working weapons," and "any form of ammunition" on the movie set.
