Jack Smith, the special counsel investigating Donald Trump's handling of classified documents, is reportedly eyeing to talk to one of the former president's lawyers to testify before a grand jury.

person familiar with the matter told CBS News that prosecutors said they need to learn more about an alleged June 2022 call between Trump and his lawyer, Evan Corcoran.

At the time, investigators sought to secure classified documents at Trump's home. The source noted that prosecutors want to know what the former president may have said during the alleged conversation, including whether he instructed Corcoran on how to handle the subpoenas.

The chief judge presiding over the case has yet to decide whether the Trump attorney will be called to testify about the call in the coming days.

Corcoran has appeared before a grand jury. However, he refused to answer questions regarding communications with the former president, citing attorney-client privilege.

Corcoran citing attorney-client privilege, urged prosecutors to seek the use of a "crime-fraud exception," wherein the attorney-client privilege would not apply if the discussions include illegal activity.

A second person familiar with the investigation said some key questions remain unanswered, such as what Trump told his attorneys before and after the Federal Bureau of Investigation searched Mar-a-Lago in Florida.

Donald Trump Communications With Attorney

ABC News Go reported that it was not immediately clear how Jack Smith's investigators found out about the call or why they are now focusing on it as part of their investigation.

Another attorney of the former president, Jennifer Little, is also being asked to testify. Little has also claimed attorney-client privilege.

She has been representing Trump in Fulton Country, George, amid the investigation that Trump and his allies sought to overturn the results of the 2020 presidential election in the state.

A spokesperson for Trump told ABC News that the former president "has done nothing wrong." The spokesperson added that "radical democrats" still "weaponize the justice system" against Trump.

According to the source, Corcoran declined to answer questions about his efforts to locate possible classified documents after the government sent the subpoena.

Donald Trump Classified Documents

In February, people familiar with the matter noted that the Justice Department wanted to know how a boxload of classified documents ended up at Mar-a-Lago.

According to CNN News, Jack Smith's investigators interviewed a Donald Trump aide who copied classified materials found in the box using her phone to put them onto a laptop.

Prosecutors then subpoenaed the password to the laptop after a voluntary interview with the aide. One of the sources said that the aide provided the password to investigators. The classified documents were discovered in December.

Tim Parlatore, an attorney for Trump, noted that the said Trump aide did not see the classified markings on the documents. Parlatore added that they called the Justice Department to inform them about it as soon as they found out.
