Donald Trump may be disqualified from running in 2024, and this is all thanks to the 14th Amendment. The argument for this is connected to his election scandal, as Trump was behind the January 6 Capitol insurrection in his effort to overturn the 2020 election results.

The argument was made by Sen. Tim Kaine of Virginia last Sunday, and the Democrat says he believes that there is a solid legal argument for using the 14th Amendment to remove Donald Trump from the 2024 ballot.

"In my view, the attack on the Capitol that day was designed for a particular purpose at a particular moment, and that was to disrupt the peaceful transfer of power of as is laid out in the Constitution," Kaine said in an interview with ABC News's George Stephanopoulos. "So I think there's a powerful argument to be made."

The Democratic senator argued that "The language is specific." This referred to a section in the 14th Amendment that stated that a previous official "who, having previously taken an oath, as a member of Congress, or as an officer of the United States, or as a member of any State legislature, or as an executive or judicial officer of any State," can still run for office if that person "engaged in insurrection or rebellion against the same, or [gave] aid or comfort to the enemies thereof."

In other words, because Trump was involved in the scheme to overturn the election results and keep himself in power illegally through a violent insurrection on January 6, 2021, he may be barred from ever seeking office again.

Legal Experts Agree That Donald Trump May Be Disqualified From Running in 2024

While Donald Trump is saying that all the legal actions against him are just political interference, legal experts, including several conservative ones, are saying otherwise as they argue that there are grounds to disqualify the former president.

Law professors from the conservative Federalist Society argued that because of the "Insurrection Clause," Trump may be disqualified from running just as if he were only 24 years old or not born a US citizen. Rep. Raskin, a Maryland Democrat, agrees with the conservative law professors.

Ned Foley, the director of election law at Ohio State University's Moritz College of Law, told PBS News, "Because it's a Civil War provision in the Constitution, there was some litigation around this clause back in the 19th century, but - and it has been tested not for a presidential election, but for lower offices."

Adam Schiff Says 14th Amendment Disqualification 'Fits Donald Trump to a T'

Meanwhile, California Democratic Rep. Adam Schiff stated in a recent interview that he also agrees with the 14th Amendment argument that former President Donald Trump is disqualified from holding elected office again.

"I think it is a valid argument. The 14th Amendment, Section 3 is pretty clear. If you engage in acts of insurrection or rebellion against the government, or you give aid and comfort to those who do, you are disqualified from running," Schiff stated in an interview.

According to the Democrat also pointed out, "It doesn't require that you be convicted of insurrection. It just requires that you have engaged in these acts."

He then added, "It's a disqualification from holding office again, and it fits Donald Trump to a T."
