Nevermind that the "NBA2K" is a successful video game, its developer Take Two Interactive and Visual Concepts are being sued over the apparent illegal use of the players' tattoos. According to ESPN, Solid Oaks Sketches recently filed a suit stating that the tattoo arts were their copyrights.

Solid Oaks Sketches, however, offered the "NBA2K' developer the option of paying $1.1 million in exchange for the permission to use the tattoos. Take Two Interactive is yet to make a statement regarding the said offer. Solid Oak Sketches filed the suit in a New York Federal court on Monday.

The case of Take Two having issues on the players' tattoos in "NBA2K" is a total opposite of the video game "Madden 15." This is because Colin Kaepernick was able to acquire the license and permission from his tattoo artists, Endless Ink's Nes Andrion and Humble Beginnings' Orly Locquiao.

The acquisition was prompted by the NFL Players Association, urging its players to secure a waiver from their artists if they wanted their tattoos to be included in the video. A successful lawsuit against the illegal use of tattoo arts was recently experienced by Victor Escobedo, a tattoo artist that sued "UFC Undisputed" after it illegally used his lion tattoo on Carlos Condit.

Despite primarily filing for a $4.1 million lawsuit, he was instead awarded $22,500. Solid Oak Sketches is filing suit over the alleged use of tattoos on LeBron James bearing a "child's portrait" and "script rolls" on his forearm. Kobe Bryant, on the other hand, had butterflies on his arm.

Darren Heitner of Heitner Legal, who is representing Solid Oak Sketches said, "It's clear that they knew that this was something that has to be negotiated."

According to Attack of the Fan Boy, 2K Sports didn't have this particular problem in "WWE 2K16" as players were able to secure their own waiver from their respective tattoo artists. At the time, the only problem they encountered was on Brock Lesnar's shorts sponsors.

In a PDF copy of the lawsuit released by Consumer Media, Solid Oak Sketches also alleges 2K Games Inc. with copyright infringement. The lawsuit details the background of the game's sales, including its apparent release dates. It also cites that the success is partly because of graphical arts.
