Mexican artist Paulina Rubio lost a significant battle in her fight against her ex-husband Nicolás Vallejo Nájera, better known by his nickname "Colate," for custody of their son, Andrea Nicolás. A judge in Miami, where the former couple is engaged in an intense battle over the boy, who is now 14 years old, ruled.

The lawsuit, first for divorce and since then for the rights to the now-teenager, has been going on for longer than the five years Paulina and Colate were married. The first court battles date back to 2012 and have not stopped since.

The most recent clash began a couple of months ago, when Nico refused to return to his mother's house after a visit with Colate. The youngster even testified directly in court, claiming he was being abused.

Paulina's lawyers countered that the boy had been kidnapped by his father , but apparently the judge handling the case was not convinced by this argument, so this week she ruled that Nico could go to Spain with Colate for the remainder of the summer vacation.

However, it was stipulated as a condition that the artist would take the boy herself and pick him up, eliminating the possibility of a kidnapping.

It's currently unknown whether Paulina has already taken Nico to Spain. What is known is the return-to-school date in Miami, where the school year begins in mid-August, so we're talking about about a month of the remainder of the vacation.

However, the big question is what will happen when it's time to return to Miami, as the judge has yet to rule on where the boy's primary residence will be, with his father or his mother. Nico has said he prefers to stay with Colate, but Paulina asserted that her words are part of her ex's effort to "program" the boy.

Andrea Nicolás is the eldest son of La Chica Dorada. Paulina Rubio is also the mother of Eros, the product of her relationship with fellow Mexican artist Gerardo Bazúa. Both Colate and Gerry have settled in Miami, where Paulina has her main home, to be close to the children.
