Empire State Building's management is not a fan of nude photography. On Monday, the team filed a $1 million lawsuit against Allen Henson, who did a topless photo shoot on the building's observatory in August.

Henson, a 30-year-old photographer, took pictures of a topless model named Shelby Carter amidst a crowd on the building's 86th floor deck with his cell phone.

"We were doing a social experiment," the photographer said.

Henson's credits include topless photo shoots in Manhattan's Peninsula Hotel and Central Park. Inspiration for these shoots came when he discovered a May 2013 New York City memorandum that states that police cannot arrest a female for going topless in public.

"When I heard it was legal, I thought 'Really?!' On paper it sounds great, but I wanted to see how it worked out in the world," Henson explained to USA TODAY.

According to the photographer, the racy photos were not professional pieces. Still, owners of the building say his work damaged the building's family-friendly reputation without their permission. According to the New York Supreme Court papers, the Empire State Building is to be a "safe, secure and appropriate place for families and tourists."

"I think they are being bullies," Henson said. "They aren't in touch with what is going on, but they are involved with so much litigation. To them, this is just another lawsuit. I don't think they take it very seriously, either."

Henson said that tourists barely noticed the show.

"We thought it would just be wonderful, a great view... no harm no foul," he told the BBC. "Nobody was injured. No children were around."

Henson denies allegations that he used the controversial photos for commercial purposes and has retained a lawyer.

"We're gonna round up an army of half-naked women and march into the courtroom and cause a huge scene," Henson joked during an interview with The Gothamist.

The playful photo shoot may end up costing the photographer a lot of money, but he is looking at the bright side.

"On a side note, she had wonderful breasts," he said.
