ICE Arrests Illegal Immigrant For Child Rape, Sexual Abuse Charges

After being released by the NYPD despite charges of child rape and sexual abuse, an illegal immigrant has been detained by the U.S. Immigration and Customs Enforcement (ICE) officers on Monday, according to Fox Live News.

On Feb. 27, NYPD arrested 20-year-old Guatemalan national Miguel Federico Ajqui-Ajtzalam and detained him. ICE's Enforcement and Removal Operations (ERO) New York's Criminal Alien Program submitted a detainer to the New York City Department of Correction (NYCDOC). However, due New York City's sanctuary policies, the detainer was ignored and the perpetrator was subsequently arraigned and released from NYCDOC's custody.

According to the ICE press release, Thomas R. Decker, field officer director for ERO New York, said it was "inconceivable" that Ajqui-Ajtzalam should be released back into the community instead of being transferred to ICE.

"It's frightening that our detainer was ignored and he was released onto New York City streets to possibly re-offend," Decker added. "The safety of city residents, especially the more vulnerable, continues to be a priority for ICE enforcement."

U.S. Border Patrol (USBP) first spotted Ajqui-Ajtzalam in September 2016 after illegally entering the U.S. without going through inspection, ICE said. He was processed as an unaccompanied alien child and was issued a Notice to Appear. After which, he was released from ICE custody in November that year on an Order of Recognizance (OREC) pending removal proceedings.

As of writing, Ajqui-Ajtzalam is under ICE custody before he is set to appear before a federal immigration judge.

Based on ICE's records, in 2019, the federal immigration authorities have removed or returned 267,000 illegal immigrants. Within that period, ERO has arrested 143,000 aliens, more than 86 percent of whom had been convicted or had pending criminal charges.

By lodging detainers on individuals who have been arrested on criminal charges, other law enforcement agencies will be asked to notify ICE prior to their release and to detain the said individual for a brief period of time until ICE can take over the custody of that person in a safe and secure setting upon release from that law enforcement agency.

However, when law enforcement agencies fail to honor immigration detainers and release serious criminal offenders onto the streets, it compromises its ability to protect public safety and carry out its mission, and worse, presenting a potential public safety threat, according to the ICE press release.

"Despite the severe challenges that local policies have created for ICE, we remain committed to our public safety mission and we will continue to do our sworn duty to seek out dangerous criminal aliens and other immigration violators," a statement by the agency. "ICE seeks straightforward cooperation with all local law enforcement and elected officials."

According to an article by Latin Post, President Donald Trump has made it clear several times, that his administration aims to protect legal, law abiding, tax paying Americans first.

To simply put it, failure to meet the central government's immigration requirements due to sanctuary policies questioned the Trump's administration and are deemed to face drastic consequences.

This includes withholding the funds that are granted by jurisdiction to sanctuary cities that insist on protecting criminal, illegal immigrants from arrest and deportation.
